Kissimmee DUI/DWI Defense Lawyer
Did you know?
If you have been arrested for drunk driving in Florida, you only have 10 days to file for a hearing with the Department of Motor Vehicles to prevent your driver's license from being suspended. To protect your driver's license, contact a lawyer as soon as possible.
In Florida, a drunk driving arrest can cost not only your driver's license, but thousands of dollars in fines and other costs. Even when you are able to drive again, you will have to pay high-risk auto insurance fees for the next three years.
I'm Kissimmee criminal defense attorney Richard Nick Kelley. I understand that a drunk driving arrest can lead to a lot of anxiety about your future. You can contact me 24 hours a day, seven days a week for a free initial consultation about your case.
Never Plead Guilty to Drunk Driving Without Talking to a Defense Lawyer
An investigation of your drunk driving arrest and a review of the state's evidence by an experienced lawyer may reveal defenses that are not immediately apparent.
Almost every DUI/DWI arrest report says the same types of things:
- That you committed a driving infraction such as a wide turn, driving too slow, weaving, or failure to maintain a single lane
- That you had liquor on your breath, glassy or bloodshot eyes, or a flushed face
However, there are numerous ways to challenge the police officer's observations. You may have been weaving because you were talking on the cell phone. If you had bloodshot eyes, it may be because of fatigue, contact lenses or any number of other reasons. It is impossible to tell what, when or how much someone has been drinking from odors on his or her breath.
Many of the defenses in DUI/DWI cases are based on what the officer did or did not do when arresting you. Field sobriety and blood alcohol content (BAC) tests may be suppressed or challenged in court.
