Investigating Your Arrest
Most boating under the influence (BUI) cases are handled by a wildlife fish and game officer and not an experienced police officer who has knowledge in handling DUI cases. Often these officers are inexperienced and ill-trained to make these arrests. Under the Florida Constitution and the Florida Statutes, they have the absolute right to board your vessel for safety inspection purposes. In the cases that I have handled, these officers will do this in order to initiate a BUI investigation.
I have been successful in getting some of these cases dismissed before trial by a Motion to Suppress based on lack of probable cause to initiate a BUI investigation. Regardless, an experienced attorney is needed to investigate each case thoroughly to uncover all possible defenses.
